GPS Route Disclaimer, Assumption of Risk, and Release of Liability
By accessing, downloading, viewing, following, or using any GPS routes, tracks, maps, files, descriptions, or related content (collectively referred to as “Routes”) provided by xpeditionpgh (“Provider”), you acknowledge, understand, and agree to the following terms and conditions:
1. No Guarantees of Accuracy or Legality
The Routes are provided for informational and recreational purposes only. While reasonable efforts may be made to research and create these Routes, no guarantee is made regarding their accuracy, completeness, safety, legality, or current status.
Road conditions, land ownership, access permissions, gate closures, seasonal restrictions, and legal designations can and do change without notice. Portions of a Route may include or lead to:
- Private property
- Roads closed to motor vehicles
- Roads restricted by the Pennsylvania Game Commission
- State Game Lands or other areas where motorized travel is prohibited
- Temporarily or permanently closed roads
- Roads unsuitable for motorcycles
It is your sole responsibility to verify that every road, trail, or area you travel is legal, open, and permitted for motorized use at the time of travel.
2. Rider Responsibility
You acknowledge and agree that you are solely responsible for:
- Determining the legality of every road or trail you ride
- Obeying all local, state, and federal laws and regulations
- Respecting private property and posted signage
- Avoiding restricted areas, including but not limited to Pennsylvania State Game Lands where motorized travel is prohibited
- Choosing routes appropriate for your skill level, motorcycle, and conditions
The Provider does not grant permission to ride on any land and does not authorize access to private or restricted property.
3. Assumption of Risk
Motorcycle riding, especially on unpaved or remote roads, is an inherently dangerous activity that involves risks including, but not limited to:
- Serious injury or death
- Mechanical failure
- Falls, collisions, or loss of control
- Wildlife encounters
- Weather changes
- Poor road conditions
- Limited or unavailable emergency services
By using the Routes, you voluntarily assume all risks, known and unknown, associated with motorcycle travel and navigation.
4. No Liability for Injuries, Damages, or Death
To the fullest extent permitted by law, you agree that xpeditionpgh, its owner(s), contributors, affiliates, and representatives shall not be held liable for any injury, death, loss, damage, or expense arising from:
- Use or misuse of the Routes
- Inaccurate or outdated information
- Legal violations or trespass
- Navigation errors
- Accidents or incidents of any kind
This includes, without limitation, personal injury, wrongful death, property damage, fines, citations, or legal consequences.
5. Indemnification
You agree to indemnify and hold harmless xpeditionpgh from any claims, demands, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of your use of the Routes or your violation of any law or third-party rights.
6. No Emergency or Support Services
The Provider does not offer rescue services, emergency response, mechanical assistance, or real-time route updates. You are responsible for carrying appropriate safety gear, navigation tools, communication devices, and emergency supplies.
7. Acceptance of Terms
By accessing or using the Routes, you confirm that:
- You have read and understood this disclaimer in full
- You accept all risks involved
- You agree to be solely responsible for your actions
If you do not agree to these terms, do not use the Routes.
